IPurviShah shall not be responsible in any form or manner for the misuse or infringement of such intellectual property. You also agree that in case of loss of package or any non-delivery thereof, IPurviShah shall not be responsible for any subsequent loss of your data and material, or misuse of your data and material by any third party.

You further agree that you shall not use the Website for any infringement of any intellectual property rights, criminal activity, or for any other violation of the law. IPurviShah shall not be held liable for any such infringement, criminal activity, or any other violation of the law.

By using this Website, you agree that the Products advertised on the Website may vary from their description on the Website. Any and all references, images, prices, specifications, designs, and availability of the Products are subject to change without notice. You further agree that as for sale on the Website are highly customized, unique, and specialized, you shall not be entitled to exchanges for any of the Products purchased by you on the Website. You also agree that refunds shall only be provided for products determined to be defective by IPurviShah, for an amount at the sole discretion of IPurviShah, and only in the form of store credits/transfer issued by IPurviShah. IPurviShah reserves the right to make and amend return polices from time to time.

IPurviShah further reserves the right to investigate complaints or reported violations of the Terms of Use and to take any action it deems fit, including but not limited to reporting any suspected unlawful activity to government authorities, police, regulators, or other third parties and disclosing any information to such persons or entities in connection with e-mail addresses, usage and purchase history, IP addresses and traffic information.

Modifications:

IPurviShah may revise and update these Terms of Use at any time at its sole discretion. Your continued usage of the Website after any changes to these Terms of Use will be deemed as acceptance of the said changes. Any aspect of the Website may be changed, supplemented, deleted or updated without notice, at the sole discretion of IPurviShah. IPurviShah may also change or impose fees for products and services provided through the Website at any time, at its sole discretion. You are responsible for regularly reviewing the Terms of Use.

Returns, Refunds, and Exchanges:

Please note that in case of returns and refunds, all products must be in unused condition with all labels and packing intact.

If you do not like the product you received or you ordered a wrong product, no returns will be accepted and no refunds processed in such cases

Damaged: In case the product received is damaged, or different from the one ordered, please write to us at ipurvishah@gmail.com  within 36 hours of receiving the product along with the pictures of the defect. No claims/complaints made after 36 hours post receipt shall be entertained. Once your claim is received, reviewed and accepted on a preliminary basis by IPurviShah, IPurviShah shall arrange for a reverse pick-up for the same. Once the returned product(s) are received back, they will be checked. Upon satisfaction, IPurviShah will issue credit note with validity period of 4 months only if the same product is unavailable to be replaced. This process will take 7-10 working days (Sundays and Public Holidays not included) from the date of raising the return request.

 

 

 

General conditions of return for all products

Incomplete order/Product missing: If you did not receive a product in your package or find that the product is missing, please write to the customer support team of IPurviShah at ipurvishah@gmail.com with your order number within 36 hours of receiving the shipment. No claims/complaints made after 36 hours post receipt shall be entertained. Upon investigation and acceptance of your claim, IPurviShah will dispatch a new product or provide you with a credit note with 4 months validity or refund to the original mode of payment (as preferred by you) only if the product is unavailable. Any claims made beyond 36 hours shall not be accepted.

 

Package status is RTO or Return to origin:

In case the package is returned to origin due to incomplete address / wrong contact number/ customer refusal / customer out of town / incorrect pin code, IPurviShah provides the option of a reshipment at an additional shipping cost of Rs. 60/- in order to reship the goods, to the same or an alternate address. In case you do not wish to reship your package, a refund would be made to your original payment method after the deduction of Rs.40/- as shipping charges.

Intellectual Property

Any and all intellectual property rights associated with the Website and its contents as made available by IPurviShah are the sole property of IPurviShah and/or its affiliates. You may not copy, imitate, reproduce, modify, amend, lease, loan, sell and/or create derivative works from, upload, transmit, and/or distribute any of the contents of the Website in any form or manner without the prior permission of IPurviShah and/or its affiliates, as the case may be. Except as expressly provided herein, IPurviShah does not grant any express or implied rights to the intellectual property over the contents of the Website.

By uploading content to or submitting any materials for use on the Web Site, you grant (or warrant that the owner of such rights has expressly granted) IPurviShah a perpetual, royalty-free, irrevocable, non-exclusive right and license to use.

You agree that IPurviShah, at its sole discretion, may terminate or suspend your use of the Website, at any time and for any or no reason at its sole discretion, even if access and use continue to be allowed to others. You agree that IPurviShah shall not be liable to you or to any third party for any termination or suspension of your access to the Website.

IPurviShah reserves its right to initiate proceedings in accordance with the law against any direct or indirect attack on IPurviShah, its owners, employees or third-party contractors and freelancers.

Limitation of Liability:

IPurviShah shall not be responsible for any injury, loss, liability, claims, or damage of any kind arising out of your use of the Website. IPurviShah shall not be responsible for any direct, indirect, incidental, punitive, exemplary or any other form of damages that is caused by (or connected with) your use of, or your inability to use, this Website on any basis whatsoever. Your remedies are limited to those provided herein to the degree that such limitations are permitted by the law.

Governing law and jurisdiction:

These Terms of Use are governed by the laws of India and are subject to the exclusive jurisdiction of the courts in Mumbai, India.

Disclaimer of Warranties:

The Website has been made available to you on an as-is basis. IPurviShah hereby disclaims all warranties, whether express or implied, and including but not limited to non-infringement, fitness for a particular purpose, and merchantability. No representations and/or warranties are made to you concerning the accuracy or completeness of any of the content uploaded by IPurviShah on the Website. No information obtained by you from the Website shall create any warranty not expressly stated by IPurviShah.

General:

By agreeing to these Terms of Service, you agree to the Privacy Policy of IPurviShah https://IPurviShah.com/privacy-policy/  by incorporation hereto, and consent to the continuous use and processing of Personal Data by IPurviShah for the purposes specified therein. IPurviShah is not responsible for any compromise of Personal Data caused by breach of the Website or otherwise.
